What are the rules of intestacy?

When a close relative or spouse dies without leaving a will they are said to have died ‘intestate’. When this happens, the rules of intestacy apply to determine who will administer and benefit from the deceased’s estate.

In such circumstances, the first step is to establish who should be administering the estate.
